UK Internet Sites Ltd requires that each customer understand and agree to the following:

UK Internet Sites Ltd reserves the right to amend and update these Terms and Conditions at any time giving notice of when changed terms are posted on the British NIC website via the Customers Control Area or in an email/newsletter.

1. Commencement and Termination.

This Agreement shall come into force upon your acceptance as a customer and shall remain in effect until terminated.

The customer is entitled to terminate this Agreement with immediate effect at any time without further costs. The customer must cease to use the service immediately upon the termination of this Agreement and move any domain names they have to another provider or release them via the Nominet customer system.

UK Internet Sites Ltd is entitled to terminate this Agreement and/or suspend the customer from the British NIC service at any time, giving reasonable notice where possible.

2. Ordering a Domain.

Domain names requests are done manually and are not yours until we have processed your order, and let you know it has been successful. Until you receive conformation you can not assume any domain name you have applied for is yours.

Occasionally the Nominet Whois (domain look up) server may return a result saying a domain name is available that has been prior registered, this is outside of our control and apologise if this happens, we will notify you if you place an order if this is the case.

UK Internet Sites Ltd cannot guarantee that your will get your choice of domain name. We will confirm if your choice of name has been successful, if we cannot secure your name we will refund any payment in full.

3. Cost of Service.

The British NIC price displayed on the website includes all registration fees for Nominet, domain name server updates at Nominet, parking and re-delegation of TAG to another ISP's. Hosting, Design and other services are not included.

British NIC offer free web and email forwarding with no adverts with all domain names sold, this is a free added service that we do not guarantee and can be removed from any customer at any-time. Customers found to be abusing the service, having very high system usage or at the sole discretion of UK Internet Sites Ltd for any reason we see fit can have the service removed without notice at any-time.

Should UK Internet Sites Ltd make any changes to our current charges, you will not be liable to pay the new rate until your renewal date is due. If you no longer wish to use our services after any price change, you will have the option to change provider at your own cost, at any-time before the renewal is due.

All sales are final, no refunds (unless we can't get your choice of name) so please check your order to make sure you are buying the correct name, if you make a spelling mistake it can not be fixed, so double check before you order.

4. Domain Name and Email Forwarding.

The domain name and email forwarding service shall not be used to store/send pornographic material. Adult material, although not necessarily pornographic, is also prohibited. You must not use the service for any illegal activity both in the UK or abroad. You are fully responsible for what happens with your domain name.

The domain name and email forwarding service shall not be used for the sending of unsolicited e-mail (Spam). We have a strict policy of not hosting any names that participate in "spamming". If you spam, your domain name will be de-tagged and removed from our service and we may bill you for any work we have to do because of your actions, so don't do it.

UK Internet Sites Ltd reserve the right to withdraw the domain name and email forwarding service at any-time, for any reason, without notice.

UK Internet Sites Ltd may park non-active domain names on our system with the purpose of displaying informational notices and advertisements. At our discretion we may also park overdue domain names with a notice to renew, if you have not contacted us to renew the domain name in advance.

5. Renewals.

Renewals are the customer's responsibility and you must get in touch and renew your domain name before it becomes due. We will try to contact you via email before the domain name is due (6 months to 30 days before), however because of the nature of email we make no guarantee that you will receive such communication and you must take steps to remind yourself when your renewal is due. Not paying for your renewal before the due date will result in your domain name being deactivated (.uk domain names have a 30 day grace period before suspension) and will be entered back in to the available domain pool allowing someone else to purchase the domain.

You can renew your domain name via the customer control area, renewals are on a 2 year basis at the current price listed in our price list.

If you do not renew a domain name and it expires, it will go back in to the available pool of domain names and anyone in the world can register it. If your domain is expiring but has not yet expired you should still be able to reactivate it by simply renewing your domain.

6. Support.

Customer's can control most aspects with regards maintenance and updating domain names via the customer control area. We do not offer telephone support for domain name customers. All support requests/enquiries should be made via sales and support contact form found at http://www.britishnic.com/support.html we will endeavour to reply as quickly as possible but should never be longer than 5 working days. If you're not happy with any response you receive you can reply asking for a director of the company to review it.

If you wish to make a complaint about any aspect of our service you can do so via the sales and support form or you can write to us at UK Internet Sites Ltd, Dept. British NIC, Centrum House, 38 Queen Street, Glasgow G1 3BU.

7. Indemnification.

The customer shall keep UK Internet Sites Ltd indemnified against any claims for damages or other claims for compensation arising from the contents of the customer's domain/website or any incorrect information given to UK Internet Sites Ltd by the customer.

8. Liability - System failure, viruses, damages, downtime.

UK Internet Sites Ltd shall not be liable to the customer for defects in the service, interruptions in the accessibility to the service, infringements on data or loss of data on the information handling system, defects in the security system or viruses or other harmful software components, loss of profits, contracts, loss of reputation, loss caused by any third party deleting, removing, deactivating or tampering with the customer's domain/website or other indirect or consequential loss whether arising from negligence, breach of contract or whatsoever.

UK Internet Sites Ltd do not guarantee data stored on our systems to be backed up.

UK Internet Sites Ltd shall not be held liable for any loss or damages caused by the use and misuse, unavailability or removal of any service.

9. Legal Content.

The customer is solely responsible for his/her domain/website and all its contents and shall ensure that they conform at all times to all applicable laws and regulations. If the customer is based outside of the United Kingdom then they must also undertake to ensure their domain/website is compliant with the laws of the United Kingdom.

10. Legal Age.

The customer confirms to UK Internet Sites Ltd that the customer is not a private individual less than 18 years of age. If you are under 18 years old and would like to become a customer, you must get a parent or guardian to order the domain on your behalf.

11. Applicable Law.

UK Internet Sites Ltd shall not be liable for the legality of British NIC service in countries other than the United Kingdom. The customer is solely responsible for the legality of the use of the service if the customer is registered to British NIC service from a country other than the United Kingdom or if the customer's domain/website is on a server in a country other than the United Kingdom.

This Agreement is subject to the laws of Scotland and shall be subject to the non-exclusive jurisdiction of the Scottish courts.

If any dispute arises out of this Agreement the Parties will attempt to settle it by a mediation procedure as the parties may agree in writing.
